§ 1 General Provisions
Use of the services provided by Montu Therapeutics is subject to these terms and conditions.

The provider of the online services at www.alternaleaf.de is Montu Therapeutics GmbH, represented by Managing Director Raphael Strauch, Schaperstr. 18, 10719 Berlin.

These terms and conditions apply exclusively to the services described in § 2 for consumers/patients.

§ 2 Scope of Services
1. Montu Therapeutics is a service platform through which physicians, medical care centers (MVZs), and other healthcare providers licensed in Germany can provide services (hereinafter "Health Platform"). Montu Therapeutics itself is not a healthcare provider, in particular not a physician, medical care center, or pharmacy.

Through the platform, patients gain access to private medical video consultations via a data protection-compliant video module. Physicians should only provide consultation or treatment exclusively via communication media if this is medically justifiable and the required medical care is maintained, particularly through the manner of diagnosis, consultation, treatment, and documentation, and the patient is also informed about the specifics of providing consultation and treatment exclusively via communication media.

Consultation and/or treatment via telemedicine is only possible for those medical conditions that, after an individual assessment of the patient's concerns by the physician, are suitable for remote treatment based on generally accepted professional standards.

Montu Therapeutics facilitates contact between patients and doctors in the context of telemedicine.

2. Montu Therapeutics assumes the following tasks for the user in particular:

  • Appointment booking system for doctors to accept patient requests and arrange telemedicine appointments.
  • Partner doctors have years of experience and sufficient professional liability insurance in accordance with medical professional codes.
  • Provision of the digital platform that underpins all processes.

3. Minors under 18 are not permitted to use the services, including telemedicine. It is the doctor’s responsibility to assess a minor's capacity to consent.

4. Doctors may issue private e-prescriptions via the platform. These are transmitted digitally to cooperating pharmacies, as selected by the patient.


5.Montu Therapeutics is not a party to the private treatment contract between patient and doctor, and is not responsible for its content or related communication.

6. Only private video consultations (self-pay) are available. Therefore, only private prescriptions may be issued.

7. Montu Therapeutics does not deliver medications or participate in the patient-pharmacy contract. When a patient chooses to fill a prescription via the platform, they enter a separate contract with the selected pharmacy. With proper consent, the platform only transmits the necessary data or prescription.

8. The Montu Therapeutics web version supports the two most recent versions of Chrome, Firefox, and Safari.

§ 3 Registration

To use the platform, users must register for a free personal account. Registration requires that users provide accurate and complete data as requested in the registration form. Users must be at least 18 years old and fully legally competent. Multiple registrations are prohibited.

There is no legal entitlement to the services offered by Montu Therapeutics. Montu may refuse registration without giving reasons.

§ 4 Right of Withdrawal

You have the right to withdraw from this contract within 14 days of confirmation (registration) without providing a reason.

You may use the attached withdrawal form, though it is not mandatory. To meet the deadline, it is sufficient to send your notice before the period expires.

Your right of withdrawal expires early if the service has been fully rendered and you have expressly agreed to this condition upon registration, acknowledging the loss of withdrawal rights upon full service delivery.

Consequences of Withdrawal

If you withdraw, we will reimburse all payments within 14 days of receiving the notice. We use the same payment method unless otherwise agreed. Montu currently does not charge users. Charges from doctors are excluded from this policy.

§ 5 Data Protection and Security

The security of our users and patients is important to us. Although we strive to protect your data and your account, we cannot guarantee that unauthorized third parties will not be able to breach our security measures. We ask you to keep your password safe. Please notify us immediately if you discover that the security of your account has been compromised or has been accessed without authorization. Detailed information on how we handle your data can be found in our privacy policy, which you confirm your acceptance of during registration.

§ 6 Availability

Montu Therapeutics' services are generally available 7 days a week, 24 hours a day. This excludes the times when data backups are being performed and system or database maintenance or program updates are being carried out. However, Montu Therapeutics cannot guarantee that video consultations will be offered continuously by external physicians during these times. The physicians are established in their own practices and decide for themselves at what times they offer video consultations via the platform.

§ 7 Rights of Use

The user is exclusively entitled to the rights to the website granted under these terms of use. The content, information, images, videos, and databases published via the platform are protected by copyright and are owned or licensed by Montu Therapeutics. The content on the platform may only be used or reproduced for personal and not for commercial purposes. Any distribution of the content is prohibited without the express consent of Montu Therapeutics

§ 8 Liability

1. Montu Therapeutics' liability for damages, in particular due to delay, non-performance, poor performance or tortious acts, only exists in the event of a breach of essential contractual obligations, the fulfillment of which could be relied upon to a special degree. Otherwise, Montu Therapeutics' liability is excluded unless mandatory statutory provisions exist. The exclusion of liability does not apply to intent and gross negligence, as well as to culpable injury to body, health, or life. The limitation of liability also applies to legal representatives and vicarious agents of Montu Therapeutics.

2. Montu Therapeutics is only liable for foreseeable damages. Liability for indirect damages, in particular consequential damages, unforeseeable damages or atypical damages, as well as lost profits, is excluded. The same applies to the consequences of industrial disputes, accidental damages, and force majeure.

3. Montu Therapeutics is not liable for damages arising from the service relationship between the user and the physician.

4. The above limitations of liability apply to all contractual and non-contractual claims.

§ 9 User Obligations

Montu Therapeutics' service can only be offered to its full extent subject to certain rules of conduct that the user must adhere to.

  1. The user may only use the service appropriately. In particular, they will keep their user name and password for access secret, not pass them on, not tolerate or enable any knowledge of them, and take the necessary measures to ensure confidentiality.
  2. In the event of any misuse or loss of this information, or any suspicion of such, they will inform Montu Therapeutics immediately.
  3. The user is obligated to provide information required for the provision of services correctly, comprehensively, and truthfully.
  4. Users may only use electronic prescriptions and other orders in accordance with medical instructions and may not pass them on or make them accessible to third parties.

§ 10 Termination/Blocking

Montu Therapeutics reserves the right to withdraw or suspend access authorization for any reason after appropriate notification. Montu Therapeutics is entitled to terminate or suspend access immediately and without notice if there is a legitimate reason, for example a violation of our guidelines. Even after termination, the user remains bound by the relevant sections of these terms and conditions.

If the user revokes their data protection consent to the processing of health data within the scope of this user agreement, this will result in termination and thus deletion/blocking of access, as the services cannot be provided without the processing of this data.

§ 11 Prices & Payments

  1. Use of the platform service is free of charge for consumers. However, Montu Therapeutics reserves the right to introduce a fee for use in order to adapt to changing market conditions, significant changes in procurement costs, changes in sales tax, or procurement prices. If Montu Therapeutics decides to introduce such a fee, Montu Therapeutics will notify you accordingly in advance in text form. In this case, the user is permitted to terminate the contract immediately.
  2. The use of private medical services offered by independent service providers (physicians) is reimbursed according to the German Medical Fee Schedule (GOÄ) and invoiced to the patient.
  3. Consent to electronic transmission of medical invoices: Montu Therapeutics and the payment service provider commissioned by Montu Therapeutics send invoices and payment reminders from participating physicians electronically to patients. These documents are generally equivalent to paper documents. The documents are sent encrypted to protect them from unauthorized access. However, we would like to point out that the transmission of data electronically always carries the risk that this data could be intercepted, decrypted, and read by third parties. Further information can be found in our privacy policy and the data protection consent declaration you must provide.

§ 12 Amendments

Montu Therapeutics reserves the right to unilaterally amend the Terms of Use and the Privacy Policy at any time with future effect, provided that this does not result in significant disadvantages for the user or that changes become necessary due to changes in the law, case law, or the financial circumstances of Montu Therapeutics. Montu Therapeutics will notify the user of the change at least one month in advance. Registered users will be notified of any intended changes by email to the last email address provided on the platform.

The changes will become effective upon publication. If the change results in the restriction of rights or increased obligations for the user (e.g., changes to features, changes to the registration process, shortening of the notice period, etc.), the user must agree to the change. The user also agrees to the respective change by not objecting to it within two weeks of sending the email and by continuing to use the service after the change. Compliance with the two-week deadline is determined by the timely submission of the objection.

If the user objects to the change within the two-week deadline, Montu Therapeutics is entitled to terminate the entire contractual relationship without notice, without the user having any claims against Montu Therapeutics.

If the contractual relationship is continued after the user's effective objection, the previous terms of use remain valid.

§ 13 Rebooking, Cancellation or Missed Appointments

Patients have the option of canceling their booked video consultation appointment free of charge up to 24 hours in advance, without giving a reason, using a link in the confirmation and reminder emails. Rebooking is not possible within the system.

If the appointment is canceled, the customer must book a new appointment. If the appointment is not canceled in a timely manner, the patient is responsible for any resulting damages.

§ 14 Final Provisions

1. Should individual provisions of these Terms of Use, including this provision, be or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected. The invalid or missing provisions shall be replaced by the respective statutory provisions. This shall also apply if a gap requiring supplementation subsequently becomes apparent.

2. The law of the Federal Republic of Germany shall apply exclusively, excluding the UN Convention on Contracts for the International Sale of Goods and German private international law.
